Sealed Bids or Electronic Bids for the Flatbranch Regional Pump Station (MDEQ Agreement No. 342-2-CW-5.5) Project will be received by the Board of Supervisors of Harrison County at the First Judicial Courthouse, Emergency Management Conference Room, 1801 23rd Avenue, Gulfport, Mississippi until 10:00 a.m., local time on August 2, 2024, at which time the Bids received will be publicly opened and read.

The Project is a Unit Price Bid contract for the construction of a new 1,300 GPM sewer pump station, 23,200 LF of PVC force main and other associated work along Old Hwy 49.

Sealed Bids must be on file with the Clerk of the Board prior to the opening date and time as stated above. Sealed Bids must be sealed and clearly marked on the outside of the envelope as indicated Bid for Flatbranch Regional Pump Station (MDEQ Agreement No. 342-2-CW-5.5) to be opened August 2, 2024. Sealed Bid envelopes not so marked are submitted at the risk of the prospective Bidder and the County assumes no responsibility for the premature opening of same by any County employee. All bids must be on file with the Clerk of this Board on or prior to the hour and date first mentioned above. Bids sent through the mail should be addressed to the Board of Supervisors, care of the Chancery Clerk's Office, Post Office Drawer CC, Gulfport, Mississippi 39502. Bids delivered in person must be delivered to the Clerk's Office in the First Judicial District Courthouse, Gulfport, Mississippi.

The Issuing Office for the Bidding Documents is Digital Engineering and Imaging, Inc., 314 Coleman Ave. Waveland, MS 39576, (228) 463-0130. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Monday through Thursday (between the hours of 7:30 A.M. and 5:00 P.M.) and Friday (between the hours of 7:30 A.M. and 11:30 A.M.). Copies of the Bidding Documents may be obtained from Plan House as described below.

The date that the Bidding Documents are transmitted by Plan House will be considered the prospective Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from Plan House. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda, if any, obtained from sources other than Plan House.

A Pre-Bid Conference will be held at 3:00 p.m. local time on July 11, 2024, at the EMA Conference Room, Harrison County Courthouse, 1801 23rd Avenue, Gulfport, Mississippi. Attendance at the Pre-Bid Conference is highly encouraged but is not mandatory.

Bids will be received from a single prime Contractor. Bids shall be on a unit price basis as indicated on the Bid Form.

Bid security shall be furnished in accordance with the Instruction to Bidders.

For bids exceeding $50,000.00, Bidder must indicate his Certificate of Responsibility Number on the outside of sealed bid as required by Mississippi Law. Effective July 1, 2010; Per MS Code 31-3-21(3); any bid submitted by a nonresident contractor which does not attach a copy of the non-resident contractor’s current state’s preference law pertaining to such state’s treatment of nonresident contractors, shall be rejected and not considered for award. If no such preference law exists in the non-resident contractor’s state, then the non-resident contractor shall provide a statement to that effect.

If the agency is closed for any reason, including but not limited to: acts of God, strikes, lockouts, riots, acts of war, epidemics, governmental regulations superimposed after the fact, fire, earthquakes, floods, or other natural disasters (the “Force Majeure Events”), which closure prevents the opening of bids at the advertised date and time, all bids received shall be publicly opened and read aloud on the next business day that the agency shall be open and at the previously advertised time. The new date and time of the bid opening, as determined in accordance with this paragraph, shall not be advertised, and all Vendors/Bidders, upon submission of a bid, shall be deemed to have knowledge of and shall have agreed to the provisions of this paragraph. Bids shall be received by the agency until the new date and time of the bid opening as set forth herein. The agency shall not be held responsible for the receipt of any bids for which the delivery was attempted and failed due to the closure of the agency as a result of a Force Majeure Event. Each Vendor/Bidders shall be required to ensure the delivery and receipt of its bid by the agency prior to the new date and time of the bid opening.

The Board reserves the right to accept or reject any or all bids or any part of any or all bids based on a lowest and best bid determination. If the Bid documents request separate bids on phases or items of a project, the Board reserves the right to accept or reject any or all bids or any part of any or all bids based on a lowest and best bid determination on each phase or item for which a separate bid is requested. The Board reserves the right to reject any and all bids, and to waive informalities.

Bids may be held by the Owner for a period not to exceed sixty (60) days from the date of submittal for the purpose of reviewing the bids and investigating the qualifications of Bidders, prior to awarding of the Contract. No bidder may withdraw his bid within 60 days after date of submittal.

Minority and women’s business enterprises are solicited to bid on this contract as prime contractors and are encouraged to make inquiries regarding potential subcontracting opportunities, equipment, materials or supply needs.

All contracts awarded under this Advertisement will be funded in part by anticipated funds from the Mississippi Department of Environmental Quality (MDEQ) through the Mississippi Municipality and County Water Infrastructure Grant (MCWI) Program. The successful Bidder will be required to comply with all MCWI Program regulations and requirements.
